As the years progress, the volume, importance and global weight of international trade in our world gradually increases. On the other hand, the importance of the WTO rules and the international trade law established within the framework of these rules are gradually increasing. The number of WTO's 164 member states and international organizations clearly reveal the global dimension of the WTO. However, despite its great importance, this area is extremely new for Turkey and has been little studied.

In this respect, it is important to thoroughly examine and understand the WTO rules and international trade law within the context of these rules. It should be noted immediately that the concept of international commercial law meant here does not refer to the rules of law (eg lex mercatoria) that private law entities and merchants use in international agreements and transactions between each other. The discipline of law, which is mentioned here as international trade law and is included in English as International Trade Law, is mostly applied by states and other international law legal entities (e.g. international organizations) on international trade transactions, measures, regulations and acts and its framework is the WTO. It refers to the rules of law established in their treaties. These rules naturally have many consequences for the private law rules in domestic law and private law legal entities.

WTO Treaties and WTO law constituted by these agreements contain rules and commitments regarding international trade. While most of these rules are binding, some of them are also advisory. The basic rules for international trade in goods are regulated under the General Agreement on Customs Tariffs and Trade 1994 (GATT 1994). GATT 1994 is the WTO's most fundamental and comprehensive agreement. The complementary agreements of GATT 1994, which elaborate the provisions of GATT 1994 and set regulations for trade measures and barriers, extended the scope of WTO rules to many dimensions of commodity trade.

The rules for international service trade are regulated in the context of the General Agreement on Trade in Services (GATS). GATS covers various dimensions of services trade in scope. Compared to GATT 1994, GATS is designed to keep WTO members' discretion and disposal area wider. It contains both general and contingent liabilities.

The rules on intellectual property protection are regulated under the Trade Related Intellectual Property Rights Treaty, TRIPS. TRIPS combines the provisions of four different international conventions. It extends to many areas of intellectual and industrial property, including trademarks, patents, copyrights. Since the protection of intellectual property has a territorial character in general, TRIPS imposes many obligations on the WTO members that deeply affect their domestic laws regarding the protection of intellectual and industrial property rights.
